1. Booking Agreement

By making a booking through sabinillasbeach.com, you agree to these terms and conditions. A booking is confirmed once payment has been received and a confirmation email has been sent to the email address provided.

The property is operated in line with applicable local and regional requirements.

2. Payment Terms

We offer three payment options when booking:

  • Pay Now: The full booking amount is charged immediately. You receive a 3% discount on the total price as a thank-you for paying upfront.
  • Reserve Now, Pay Later: Your card details are saved securely at the time of booking, but no charge is made. The full amount is charged automatically 14 days before your check-in date. You may cancel free of charge at any time before the payment is processed. This option is available only when your check-in date is at least 14 days away.
  • Pay on Arrival: You settle the balance in cash when you arrive. A valid card is required at the time of booking as a guarantee to secure your reservation β€” it is not charged, except that if you fail to arrive without cancelling, a no-show fee equal to one night is charged.

All prices are in EUR and include applicable taxes. Payments are processed securely via Stripe. We accept credit/debit cards, Apple Pay, Google Pay, and PayPal. PayPal is available on the Pay Now option only; the Reserve Now, Pay Later and Pay on Arrival options require a card on file (to charge the balance automatically for Reserve Now, Pay Later, or as a guarantee for Pay on Arrival).

3. Cancellation Policy

Please see our dedicated Cancellation Policy page for full details. In summary:

  • Within 24 hours of booking: full refund β€” including the non-refundable Pay Now rate β€” provided your check-in is at least 7 days away.
  • More than 7 days before check-in: full refund of all payments made. No questions asked.
  • Less than 7 days before check-in: only the first night is charged. The rest of your payment will be refunded.
  • No-show (no cancellation made): the full booking amount will be charged. Please always let us know if your plans change.
  • "Reserve Now, Pay Later" bookings: free cancellation at any time before the charge is processed (14 days before check-in). After the charge, the tiers above apply.
  • "Pay Now" bookings: apart from the 24-hour grace period above, the Pay Now rate is non-refundable β€” that is the trade-off for its extra 3% discount, and the refund tiers above do not apply to it. Instead, every Pay Now booking includes one free date change (see the Cancellation Policy for details).

Right of withdrawal: please note that under Article 103(l) of the Spanish General Consumer and User Protection Law (and Article 16(l) of EU Directive 2011/83/EU), the statutory 14-day right of withdrawal does not apply to accommodation booked for specific dates. The cancellation terms above apply instead.

4. Check-in and Check-out

  • Check-in time: from 16:00 (4pm)
  • Check-out time: by 10:00 (10am)
  • Early check-in and late check-out may be available as bookable extras, subject to availability.
  • Your host will meet you in person for a welcome and key handover. The apartment door uses a smart lock with a temporary PIN provided before arrival.

5. House Rules

  • Maximum occupancy: 6 guests
  • No smoking inside the apartment
  • No pets
  • No parties or events
  • Quiet hours: 23:00 to 08:00 (as per community rules)
  • Guests are responsible for keeping the apartment in a reasonable condition during their stay
  • Community pool rules must be followed (no diving, children must be supervised)
  • Recycling: please separate waste into the appropriate bins as indicated in the guest guide

6. Liability

To the extent permitted by law, the property owner is not liable for any loss, theft, or damage to guests' personal belongings during the stay, nor for events outside our reasonable control (force majeure), such as interruptions to utilities or community services. Nothing in these terms excludes or limits any liability that cannot be excluded under Spanish law, or affects your statutory rights as a consumer.

Use of the community pool, garden, and beach is at guests' own risk; children must be supervised at all times. The property is insured for guest stays, but guests are advised to have their own travel insurance.

Guests are responsible for any damage caused to the property, furnishings, or equipment during their stay beyond normal wear and tear. We do not take a security deposit; any damage will be documented and the reasonable repair or replacement cost invoiced to the guest.

7. Guest Registration

In accordance with Spanish law, all guests must provide identification details for registration with the Policia Nacional (Parte de Viajero) within 24 hours of check-in. Your host will guide you through this process.

8. Extras and Add-on Services

Extras booked through our platform are subject to availability. Some extras (such as airport shuttles) require advance notice. Extras can be added up to 48 hours before check-in. Refunds for cancelled extras follow the same policy as the main booking cancellation.

9. Refer a Friend

Our "Bring a Friend" referral programme lets you and a friend each save 10%.

  • Every guest with a booking can find a personal referral link and code in their guest area. Share it with friends who have not booked with us before.
  • Your friend's discount: when a new guest books a direct stay using your referral code, they receive 10% off their booking. The code is for new bookings only, may be used once per guest, and is non-stackable β€” the single best discount applies and the price never drops below our standard direct rate.
  • Your reward: once your friend's stay has been completed, we email you a single-use 10%-off code for your own next direct booking, valid for 12 months. No reward is issued if the referred booking is cancelled or refunded before the stay takes place.
  • Referral and reward codes have no cash value, cannot be combined with other offers, and cannot be applied to a booking already made. You may not refer yourself β€” the referral and the referred booking must use different guests and email addresses.
  • We may modify or withdraw the referral programme at any time. Codes already issued remain valid until their stated expiry. We reserve the right to withhold rewards where we reasonably suspect abuse or fraud.

10. Gift Cards

  • Gift cards are a fixed-amount credit in EUR, redeemable against direct bookings on sabinillasbeach.com (including extras booked as part of a stay).
  • Gift cards do not expire.
  • The balance is reusable: if a booking costs less than the card balance, the remainder stays on the card for future bookings. If a booking paid partly or fully with a gift card is cancelled and refunded, the gift-card portion is returned to the card balance, not in cash.
  • Gift cards have no cash value and cannot be exchanged for cash or resold.
  • As the purchase of a gift card is not tied to specific dates, the statutory 14-day right of withdrawal applies: you may cancel the purchase within 14 days for a full refund, provided no part of the card has been redeemed.

11. Governing Law

These terms and conditions are governed by Spanish law. Any disputes will be resolved in the courts of Malaga, Spain, without prejudice to any mandatory consumer-protection rules and jurisdiction rules that apply in your country of residence if you are a consumer resident in the EU.
